Family office
The family office department provides legal, economic and tax advice to high-net-worth clients.
We advise our clients on how to structure and hold their movable and immovable assets, how to manage their wealth, and provide them with the tools they need to keep an overview.
The optimization of holding structures must also consider the client’s risk/return ratio and time horizon, as well as his individual preferences and family situation.
Our clients benefit from our extensive national and international network.
Family wealth structuring
We advise our clients on setting up family wealth management vehicles that combine security and flexibility to meet the requirements of international families whose members are domiciled in several countries or even continents.
Asset control
Our wealth management services enable our clients to always maintain an overview of their assets, with a valuation of the various elements at regular intervals, according to the type of asset involved, such as securities, bonds, receivables, real estate, private equity, hedge funds, and direct or indirect holdings in companies.
Asset monitoring measures the evolution of a global asset or its components and compares it to a benchmark index as deined by the client. This method makes it possible to compare the performance of the various service providers used by our customers and to draw conclusions. It also makes it possible to select economic sectors to be favored or avoided, and to ensure the proper diversification of assets in terms of currencies, markets, business sectors and geographical zones.
Montbenon Conseils Sàrl does not offer asset management in the strict sense of the term.
It goes without saying that the after-tax result of an investment matters to our clients which will be our ultimate benchmark.
Managing legal and tax issues
Benjamin Franklin’s quote “In this world nothing is certain except death and taxes” sums up the two realities we all face in our lives. Despite all the progress of civilization, death remains the final fate of every living being, rich or poor, young or old.
Similarly, taxes are a burden that all citizens must bear, whatever their situation. Even if their nature and rates vary greatly from one jurisdiction to another and from one era to another, they are an integral part of the social contract. They enable the financing of public services and infrastructure to the benefit of all, but they also reflect networks of influence and interest groups that seek to take advantage of the system for their clientele. This is not a problem as long as the process is transparent or democratic. If it becomes ideological (e.g. redistribution) or even demagogic (e.g. unfunded or illusory benefits), the system becomes unfair, biased or even dangerous. Too much tax kills tax. Fortunately, in liberal democracies, there is a certain amount of tax competition which helps to limit these excesses.
At Montbenon Conseils Sàrl, we operate strictly in this frame of mind when seeking solutions to the legal and tax issues that may arise for our clients. Our aim is never zero tax, but to avoid excessive taxation. We master the various legal tools available to achieve this goal, such as the use of legal structures, pension planning, real estate financing, choice of domicile, various estate and wealth planning tools, etc.
Our network of correspondents also enables us to handle complex inter-cantonal and even international situations.
We can deal with all tax compliance issues, as well as establish private and professional accounts if required.
Philanthropic activity
According to writer and philosopher Samuel Johnson, “It is better to live rich than to die rich”. This phrase highlights the importance of enjoying one’s wealth during one’s lifetime, rather than accumulating it only to bequeath it. Indeed, living rich means being able to afford material comforts, leisure activities and enriching experiences. This allows you to enjoy your wealth to the full, putting it to work for your personal development and that of your loved ones. Simply hoarding out of a desire for wealth without sharing it with those around you or with society as a whole can seem like a waste of a lifetime’s potential. Philanthropic action can be the answer to such questions and bring an intense sense of satisfaction and meaning to life.
We assist and advise our clients in setting up and managing charitable organizations and have extensive national and international experience in this field.
We offer all the services required for such initiatives, such as setting up a philanthropic structure in Switzerland and abroad, determining the purpose, obtaining approval from the relevant supervisory authority, tax exemption, accounting, project identification and follow-up, bookkeeping and all dealings with the authorities (tax declaration, annual report, etc.), auditors and all other interested parties.
